These terms apply to the supply of LED lighting products and related services (survey, design, installation and maintenance) by Polaris Light Ltd, a company registered in England and Wales under company number 09763338, with its registered office at 71-75 Shelton Street, London, WC2H 9JQ ("Polaris", "we", "us").
1. Who these terms are for
Our products and services are supplied to businesses and public bodies. By placing an order you confirm that you are acting in the course of a business. These terms apply together with our written quotation. If they conflict, the quotation prevails.
2. Quotations and orders
2.1 Our website does not show prices. All prices are given in a written quotation. 2.2 A quotation is valid for the period stated on it. A contract is formed only when we confirm your order in writing. 2.3 Technical information on our website and spec sheets is for guidance and may change without notice. The specification in our quotation or order confirmation applies.
3. Delivery
3.1 Delivery dates are estimates. We will tell you promptly if a delivery will be late. 3.2 Risk passes to you on delivery. Ownership passes when we have received payment in full.
4. Installation services
4.1 Where we install, you will give us safe access, the information we reasonably request (including asbestos and site safety information) and suitable working times. 4.2 We carry out the work with reasonable skill and care and in line with applicable UK regulations and standards.
5. Payment
Payment terms are as stated in the quotation or invoice. We may charge interest on late payment under the Late Payment of Commercial Debts (Interest) Act 1998.
6. Warranty
6.1 Every Polaris product carries a 5-year warranty from the date of delivery against defects in materials and workmanship, when installed, used and maintained as instructed. 6.2 The warranty does not cover damage caused by incorrect installation by others, misuse, accidents, power surges outside the stated surge rating, or normal wear of consumable parts. It also does not cover products modified or repaired by others, damage from water or dust beyond the stated IP rating, use outside the stated operating temperature, or faults in the customer's supply or controls. 6.3 If a product is faulty within the warranty period, contact us. We will repair or replace it, or refund it if repair or replacement is not possible. The warranty covers the replacement product and its delivery. Removal and refitting labour, access equipment and lifts are not included unless Polaris installed the product or the quotation says otherwise. Faulty products must be reported within the warranty period and made available for inspection.
7. Liability
7.1 Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. 7.2 Subject to 7.1, we are not liable for loss of profit, revenue or business, or for indirect or consequential loss, and our total liability under a contract is limited to the price paid under it.
8. Cancellation
Orders for standard products may be cancelled before dispatch by agreement. Products made or ordered specially for you cannot be cancelled once ordered from our supplier. Our Returns policy explains returns.
9. Intellectual property
Lighting designs, lux plans and documents we prepare remain ours. You may use them for the project they were prepared for.
10. Data protection
We handle personal data as described in our Privacy policyCookie policy.
11. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
